The Regional District of East Kootenay (RDEK) Board of Directors has deferred making a decision on a Temporary Use Permit application pending receipt of additional information.
“This is a complex application in that the applicant has received Preliminary Layout Review, which summarizes the Ministry of Transportation and Infrastructure’s (MOTI) requirements prior to approval to subdivide the property. MOTI requires construction of a road as part of that subdivision process. The applicant is seeking a Temporary Use Permit to extract, crush and utilize onsite aggregate to build that required road,” explains RDEK Board Chair Rob Gay.
In considering the application, the Board expressed a need for additional information to fully understand both the requirements of MOTI and the specifics of the application prior to being able to make a decision on whether to grant or refuse the Permit.
“In addition to the many questions we have that are outstanding, the neighbours raised a number of valid issues that have not yet been fully addressed,” adds Gay. “We have asked staff to seek clarification from the Ministry of Transportation on its requirements; and, to obtain additional information from the applicant around plans for dust suppression, the geotechnical requirements on the property as determined by a qualified professional, clarification around the intention to sell aggregate, and a more specific timeline for the intended work.”
While no date has been set, the Temporary Use Permit will be re-advertised and notices sent to neighbouring properties within a 100m radius of the subject property in the Wilson Road area near Cranbrook prior to the application coming back before the Board for consideration.
